Wildcats Appeal Ross Johnston Suspension

BOUCHERVILLE, Friday March 1st, 2013 - The Moncton Wildcats advised the Quebec Major Junior Hockey League today that they would appeal the 15-game-suspension decreed to Ross Johnston by the Director of Player Safety.

The League rules stipulate that a decision made by the Director of Player Safety that involves a suspension equal to or higher than six (6) games may be submitted to an Independent Arbitrator selected by the Board of Governors by a majority of two-thirds within a list of persons recommended by the Commissioner.

Review of a decision of the Director of the of Player Safety cannot be revised by the Independent Arbitrator if one or more of the following conditions apply:

- The rules of natural justice, and in particular the rules described in Section 1.05, were not followed by the Director of Player Safety;

- The Director of Player Safety did not follow the regulations concerning the recidivism or precedents (jurisprudence);

- The decision of the Director of the Department of Player Safety is unreasonable, taking into account the criteria set out in regulations, existing scales and policies of the League in disciplinary matters.

The Independent Arbitrator has the authority to maintain, increase and / or lessen the sanction imposed by the Director of Player Safety. However, this application for judicial review made ​​under this provision shall not suspend the execution of the decision of the 15-game suspension given to player Ross Johnston.

The hearing of the Request for Review shall be held within ten (10) days of the tabling of the Request and the Arbitrator's decision shall be given within five (5) days of the hearing.

The decision of the Independent Arbitrator is binding and cannot be appealed.

The Quebec Major Junior Hockey League will not comment any further until the end of the appeal process and until a decision is reached.
