The Stupidity Of It All
The lawsuit was in fact dismissed by the PBL. One must ask themselves why the PBL decided to dismiss the case? Could it be the fear of a counter lawsuit which was brewing? This crap about the ABA being judgment proof is just that " Crap". The first step that any attorney does before deciding to sue a person or an entity is to see if there are assets. If the PBL did not do their homework then they deserve to be crowned the " Clowns Of Minor League Basketball ". Whatever spin or twist that A1 tries to make of the situation, the bottom line is the ABA is still standing and the PBL did not accomplish a thing! All they did was waste their time and money and probably promised people that this would be the demise of the ABA . The ABA is stronger than ever with over 60 new teams negotiating market reservations for 2010. There is also the 200 million dollar ABA international expansion. The ABA is the fastest growing professional sports organization in the history of professional sports! A1, the PBL, or people in this forum cannot slow down our history making expansion. It's time to wise up people and join the winning team ( the ABA ) or you will get left behind.

They left themselves a lot of options by doing it the way they did.

Doubtful since the ABA was already found liable for judgment. What stand would the ABA have to counter sue? "We screwed them over and they sued us for it"?

Most of this year's teams didn't last for more than a few weeks. What makes you think 60 new teams will?

It's also the fastest contracting professional sports organziation of all time. No league has ever blown through as many teams or burned as many markets.
They left themselves a lot of options by doing it the way they did.

So, which part of the league's official website can I look at to see just what makes the ABA 'the winning team'? After all, isn't that the primary source of information in regards to how strong the league is, and the amazing strides it has taken this year? Wouldn't that be the #1 spot for up-to-date news and announcements for the league this year and beyond? If any casual fan wanted to see the great progress that the ABA has had, its tremendous fan-friendly approach to basketball, and its unmatched business savvy that has attracted all the teams now and in the future, wouldn't that be the primary location for them to see just how prescient you are?

When is the next ABA game on Versus?
Whenever I look for basketball there, it's always a D-League game.
The Versus logo is still on the ABA website, so there is obviously still a deal, right?

So if I'm reading the dismissal PDF correctly (thanks, Paul), it seems like they thought it would be useless to continue to pursue this action because:
1 - Joe has no resources to pay whatever he'd be forced to pay, or he'd finagle out of it
2 - The ABA is crap and not worth having if you did get a hold of it.
Is that pretty much it?
If I was to be meanspirited, I'd go on a mini-rant about how small the actual brainpan of someone like OldSchoolBaller was, but why bother?
The ABA may continue to exist for a while. It may outlive its founder, it may not. It may continue to find a way to find suckers who will pony up for teams that then fold, to be replaced by the next sucker. There's certainly no lack of young basketball players who believe they can be stars in pro ball if they can score 30 a night, and who don't mind driving SUVs from Calgary to Texas just to play. There's no lack of hip-hop promoters who want to be team owners, precedent be damned.
What there is a lack of is people who will watch this dreck. If the ABA is growing, it's like a fungus. But even its foibles are barely worth laughing and pointing at anymore.
You want a sad group of people? It's people like OSB. And Joe Newman, sitting in the corner, saying the same crap he's been saying for 10 years, as his mind and life slowly slide into oblivion.

3 - It appears that NBA Properties is going to move on the fact that the ABA service marks are being used in violation of the old agreement* and in absence of any known valid agreement. The PBL believes that the Jaloza/PBL lawsuit would most likely end up with assignment of Newman/Tinkham's rights to the ABA service marks to the PBL. However, since there appear to be no rights to assign, there's no use in pursuing this issue.
*At the least, the PBL indicates that Newman would have to pay between $500k and $1.5m to correct the violations of the old agreement, if they're still valid at all.
As to the original poster, I believe its two posts on this thread indicate that it is nothing more than a troll that OSC would be well rid of. There is no way that a sentient human being could read the judgement and believe it to be a "win" for the ABA -- or whatever name Newman gives the league as soon as the NBA slaps the C&D on him.
