The Jaloza and fratella law suit deals with the ABA license.
Joe' s attorneys tried to stall the decsion by trying to move the case from state court to federal court.
The federal court judge said.... NO, send it back !
The case will be sent back to state court and we all await to see how much (%) of the ABA license Jaloza and fratella get.
Im not a lawyer but this doesnt sound good, does it Joe? does it Tom?
Maybe you can get on and explain it better.

Standard, I understand you disagree with the league and how its being run but dont expect this clown to give you facts. Look what he posted about the PBL. "A friend who knowws a friend who has a friend told me..."
I mean look at his post and look how many people who respond, hardly anybody. Like I said man, you and I are cool and we have our difference of opinions but dont expect facts from this guy. And God forbid if Alex would do or say something and this guy A1 would get all willie nillie on you.
I dont understand how this guy hates the ABA so much and yet finds himself at the owners meeting every year, I mean hell he beat me there this year. That sounds like some down low issues to me.
Dont thank me, Im just stating something that others on here are thinking the whole time about this cat. I remember I got on to him about something he stated and I knew for a fact he was lying and you know what he said to me in response. "You better be careful before I tell your business" or something like, hell its not accurate but its better than what he does.
Standard, one last thing, I might want to invest in one of those teams in your league. Let me kow whatsup with that and good luck in getting facts from A1, hell I cant wait what he comes back with. Probably threaten to tell my business or something.

I got the facts already and well. I will keep them to myself also. Since Joe is tossing a lawsuit at me.(Come and sue me. lol lol.)
In regards of investing in the BSN. It's like this. "La Cosa Nostra" we don't want no "Manchester United" (AKA American Owner in Foreign Soil) partners we do allow. But the leagues due diligence in regards of ownership has gotten to a level that FBI Background checks are done.
I am right now in the process of buying less than half of the shares on the Womens league team and buying shares in the Womens Pro Volleyball team.
Do I ever plan to buy a team by myself as a majority owner? Yes I do. I intend to do this in 3 to 5 years. Can i do it? Yes. I have the money for it now, but with work and then studying in college for my 2nd masters its hard to concentrate 100% on a professional team. Thats why im a minority owner or shareholder like others would say.

Honestly he should stop worrying about the boards and worry about running a basketball league! Wheres the divisions? Wheres all the promises? Worry about that Joe, not the critics on this board

Don't slander and libel have to false?
What about this? Taken from Wikipedia's entry on Slander and Libel:
"Claimant is incapable of further defamation–e.g., the claimant's position in the community is so poor that defamation could not do further damage to the plaintiff. Such a claimant could be said to be "libel-proof," since in most jurisdictions, actual damage is an essential element for a libel claim."
I think any person on Al Gore's great interweb, could come to the conclusions that many, many, many different posters have here. That would be the "rational" conclusion.
The burden of proof in a slander and libel case in the United States is on the plantiff.
Why would Mr. Newman go to a court and point out to a judge his own behavior?

Joe, hows the situation and case going between you and Todd Wier, have you made amends? He said hes giving you until August to reach an agreement or hes not playing(Niagara Gazette 5/31) And you said there was no case and you could give info and prove it, and the Gazette never got it, last time I asked Todd about this he said we might reach an agreement, especially after that article was released, have amends been made? Is that one part of the reason why we are still questioning our future? I know people really well, but Todd would never get into specifics with me on this topic so i have no clue whats going on!
How bout the whole thing with Jaloza that a1 has been informing us on, seems like you could be done, are you worrying about that??
And now your worried about a critic, a minor league basketball fan and a person apart of a team in Puerto Rico(?) in a league that is very professional and well run and he has made comments about you, maybe you should WORRY ABOUT YOUR LEAGUE AND HOW TO RUN IT AND TRY AND TURN THINGS AROUND, MAYBE YOU SHOULD WORRY ABOUT CASES WITH MONEY AND OWED MONEY INVOLVED, NOT A FORUM ON OSC!!!!!!!
If Joe put a highly concentrated effort and didnt do things half fast, this league might be better than what it is now, a joke, obviously with you(joe) at CEO this league is falling apart, either you should make drastic changes and start doing a WAYYYY better job, OR JUST STEP DOWN FROM YOUR POSITION!!

Ive never seen something like this, a critic of the ABA on a message forum could be sued and Joe seems more concerned about what goes on here on the board than what goes on in his league!

Awright this is what we do.
If anyone gets sued,
1/ the rest of us take a day off of work immediately.
2/ we have a quick pow-wow here
3/ we hit the world wide web and dig up any proof we can. Court cases, Sec filings, articles, other current defendants/plaintiffs.
4/ put the 'proof' we find in some sort of format thats easy for us to figure out.
We work together. However I did receive a PM back to me that will remain anonymous but said "Joe's threatened to sue me before".

Keep in mind that Joe made numerous threats to the moderator of the old Yahoo board - even having his lawyer post desist notices. He also called the PA legal board to complain about a poster onthe board who happened to be a lawyer, and had a number of public run-ins with Joe. It was OK that Joe called him a terrorist and other similarly infantile, insulting comments; when the poster came back at him, Joe tried to get his censured or disbarred.
NEWS FLASH - it didn't work.
Joe may very well be the embodiment of the part of the horse that crosses the finish line last, but he has a lot of spare time on his hands, and needs to get a hobby or something to fill it more usefully...

We're actually in an area I have some working knowledge about.
For Joe to successfully sue for slander (spoken) or libel (written), he'd have to prove a number of things:
1. That the writings or spoken words against him were false.
2. That the writings or speakings caused actual damage.
3. In certain situations and states, he'd have to prove that the defendant acted in a reckless manor. (In most cases that means the defendant didn't follow the norms of journalism).
In most states (and the federal government), Joe would be classified as a limited public figure. (As opposed to a true public figure such as a politician, where it is extremely difficult to sue for libel or slander). That means a higher standard would be required for him to win if the item in question relates to the operation of the league. A less stringent standard would apply to a suit that related to his personal life away from the league or basketball.
In basketball related items, he would have to prove the statements were made with malice ("the defendant was shown to be out to get me").
It is also difficult to sue if the writings or speech was a parody, satire or done in jest. (Thanks to the suit brought against Larry Flint by the late Jerry Falwell over a fake liquor ad in Larry's mag that insinuated that Jerry's first time was with his mother.)
It is also difficult to sue over items of opinion (that doesn't mean it hasn't been tried).
Just remember, you can sue for anything. That doesn't mean you're going to win. In some states, you can be fined court costs and your opponent's legal fees for a trivial suit.
