According to the US Trademark Office in Washington DC, the ABA trademarked name and logos are owned by NBA Properties, NY NY. It was registered on May 7, 2005. The attorney taking care off this registration was Richard Friedman. It is case number 2951900. Does Joe Newman pay to use this logo and name? Ask him and I'm sure you'll get a rude, smart ass answer. Whenever you catch him in a usual pack of lies, name calling rather than the truth is usually the outcome. None of the current team logos are trademarked, meaning they are open and fair game for anyone to use for anything that they desire. Although, I am yet to see one decent logo worth a damn !!

Interesting too... especially since the filing data is in 1998 (before the start of the current ABA).

I'm not a trademark atty, but I wonder if the trademark is for the terms ABA etc. or just for that original logo.

Well, if you go over to the APBR.org message board (Association for Professional Basketball Research), it looks as if the ABA's Toledo Ice - er - Rens are going to have a problem with their name, as the rights to the name "Rens" as the nickname of a basketball team are owned by Black Fives, Inc. And this, right after the Miami Orange Men had to rename themselves the Miami Aces due to a trademark infringement on Syracuse University's old team name. Man oh man.

As I understand it, the ABA is using the name under a licencing agreement with the NBA, which owns the rights to the name. And despite all the ABA's problems, they haven't done anything to violate that agreement.

The ABA name is licensed by the NBA. When the NBA, which owns all the rights to the ABA, caught wind of the start-up league in 2000, it sued for trademark infringement. To settle the suit, the ABA paid $100,000 for use of the league's name and the red, white and blue ball made famous by the original ABA.The NBA can void the contract and take the ABA name away if it deems the league is in violation of the agreement.

By taking a year off to "reorganize" in 2002, the ABA broke a clause in its contract requiring continuous play during a 12-month span, according to the licensing agreement obtained by The Times. But the league paid the NBA $25,000 for an extension.The NBA issued a statement about the struggling league: "As we do with all licensees, we communicate directly, not publicly, with the ABA on any issues relating to its license agreement.

The D-League is now what? 5 years old? Stern could have just named the league "ABA" and nobody would blink.
