The legal system does crawl but eventually there are results. Soon 2 judgements aganist Joe and the ABA are going to come to a conclusion.
The Jaloza law suit establishing damages. Apparently Joe says he is ill and cant make a deposition but maybe they will do it bedside at his hospital ( in a quebec hotel LOL)

Apple consulting has a judgement out there and damages will soon have to be established in that case.
On another note:
ABA investors are looking into filing charges aganist Joe and the money he used to pay a judgement aganist him. Apparently there was an 800,000 dollar judgment aganist Joe himself for not paying players on an ABA team Joe owned. Somehow Joe got the ABA invloved and made a settlement with ABA investor money and not his own.SHAMEFUL.

How long has this Jalooza thing dragged out. Seems odd that (if true) Joes' lawyer says hes' far too ill to travel for a deposition but is able to go to Barre Vermont one weekend and then Quebec City, Canada the next all the while kicking out an interview every 7 days for ABA All Access.

a1, i personally am interested in the goods you get, as long as you don't get into too much of the personal stuff....just give us the facts. we can connect some of the dots ourselves.
a couple of questions though - weren't you just accused of breaking into hospital networks for the purposes of turning all of the leagues against each other? if so, isn't that a federal crime given that patient information could be compromised? didn't your actions result in threats against one of the leagues? if the former is true, then shouldn't you receive a permanent ban here and be sought out by the authorities?
i gotta say i'm one of your fans when you don't get too crazy (vt, vt, vt, alex, alex, alex, blah, blah, blah), but something doesn't smell right here. anything you can explain to the natives? (i don't mean to imply you owe me any explanation....i just don't get the sequence of events last week.)

I am going to request that when it comes to the Jaloza case that links be provided as a source of documentation. If this is a matter of public record, it shouldn't be difficult to do.

He was a former ABA business partner who alleges he was bogarted out several years ago during a league reorganization. Problem is, he wants a piece of the league, which isn't worth a whole lot right now, selling at a penny a share.

I think thats the one that Joe lost in Indiana, then appealed up to the ladder and then the higher judge kicked it back to the lower court to sort out some questions of residency.
In other words Jalooza might have sued Joe in the wrong court if he wasn't an resident of Indiana............... I'm not a lawyer just how I interpreted it.

In the past, the litigation matters could be followed through the ABA's filings with the Securities and Exchange Commission. However, it appears that ABA Inc. filed a notice with the SEC in December that they are no longer filing reports because the number of stockholders has fallen below the technical "Mendoza line" (for the purposes of discussing it on this board we can call it the "Newman Line") perscribed by the SEC. They filed an extension notice that they couldn't file their September 30, 2007 10-Q on time in November, and then shortly thereafter filed the notice that they were no longer required to file. Extensions are permitted with a valid reason - information not available, etc., but this company is so small with so little activity that it would be tough to support the need for an extension. If they were trying to buy time so that "friends" could acquire enough stock and reduce the number of shareholders to a level that would not require future SEC filings, then that's another matter entirely. Frankly, if they are targeting specific shareholders, or acting in concert, then it would require a 13-d filing, and one wonders whether it really was a tender offer (which requires a whole other series of filings with the SEC). Might be worthwhile for the SEC enforcement division to look into.

A few months ago, Newman stated on an "All-Access" interview that he made a mistake in taking the company public, and he was taking steps to make the ABA a privately owned company again.
